Credit Promotion Terms & Conditions
(hereinafter the “Promotion Terms”)
1. General & Definitions
1.1 For the purposes of these Promotion Terms, the following definitions shall apply:
“Credits” shall mean the platform’s virtual currency used within the Site(s). They are purchasable with fiat currency (or other payment methods available from time to time) on the Site(s) and serve as a unit of in-platform value for transactions, access to premium features, or promotional services.
"Duration” shall refer to the time from and to which this Promotion runs, as specified in the relevant Promotion materials, which may be distributed through various methods – including in-site promotions, email communications and social media posts - from time to time (hereinafter the “Promotion Materials”).
“Main Terms” shall refer to the Terms-of-Service Agreement, effective at the commencement of this Promotion.
“Promotion” shall mean this specific credit promotion offer, which shall run for the Duration.
“Site” shall mean, individually, the website found at either https://www.adultwork.com/ and/or m.adultwork.com or, collectively, the “Sites”.
“User(s)” shall refer to any validly registered Advertiser or age-verified Customer.
1.2. These Promotion Terms shall be read in conjunction with the Main Terms and any Promotion Materials issued regarding the Promotion, which are incorporated herein by reference.
In the event of any conflict or inconsistency between the Promotion Terms and the Main Terms, the Promotion Terms shall prevail only to the extent that they specifically address the subject matter of such conflict. In all other instances the Main Terms shall continue to apply in full force and effect.
1.3. These Promotion Terms govern only the current Promotion, as made available on the Site(s).
1.4. If any capitalized terms are used and not defined herein, they shall bear the meaning attributed to them in the Main Terms.
1.5. We hereby reserve the right to amend (all or part of), suspend, or outright cancel the Promotion at any time and without warning. We may make attempts, but are not obligated to, communicate the same through appropriate communication channels.
1.6. The provisions of section 1.5 notwithstanding, a Promotion may be limited in quantity, duration, or scope. Once such availability is exhausted, the Promotion may terminate without prior notice.
2. Participation & Conduct
2.1. All Users are eligible to participate in the Promotion so long as they meet the minimum participation criteria (e.g., minimum credit purchasing) set forth herein and in the Promotion Materials, unless explicitly communicated otherwise. As controller of the Site(s), we reserve the right to exclude a User from participating in the Promotion, in our sole discretion, with or without cause.
2.2. By participating in the Promotion, you understand and accept the Promotion Terms in their entirety, as well as any other terms & conditions that may govern the Promotion that are incorporated herein by reference. If you do not accept any part or the entirety of these Promotion Terms as well as any other applicable terms, your only recourse is to avoid participation in the Promotion entirely.
2.3. If you are found or suspected to be in infringement of the Promotion Terms, the Main Terms, or any other terms & conditions applicable to you as a User, as such may be from time to time, you may be disqualified from participating in the Promotion at any time, and any benefits acquired during the Promotion may be reverted, in our sole discretion. This disqualification is without prejudice to any other measures we may take for such infringement.
2.4. Any Credits purchased during the Promotion are non-refundable. These Credits may not be withdrawn, exchanged, or converted into cash or fiat currency, or any other form of compensation, under any circumstances. Any attempt to tamper with, manipulate, or otherwise exploit the Promotion in any way shall constitute an infringement of the Promotion Terms.
2.5. Though you are free to make multiple purchases of Credits during the Duration of the Promotion, the Promotion benefits shall only apply to one (1) purchase per User account, specifically the first purchase of Credits made that meets the qualifying criteria.
3. Limitation of Liability
3.1 We will make reasonable efforts to provide the continued availability of the Promotion for its Duration, but bear no responsibility for any technical failures, interruptions, errors, or other issues beyond our control that may affect a User’s participation in the Promotion, or any qualifying purchases made thereto.
4. Duration
4.1. The Promotion shall run for the Duration, and any Credits purchased outside of the Promotion Duration shall not be subject to any benefits offered during the Promotion.
5. Governing Law & Jurisdiction
5.1. The Promotion Terms (and any dispute arising out of the same) shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Each User agrees that the courts of the Republic of Cyprus shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Promotion Terms, or their subject matter or formation.
